Comments

When visitors leave comments on the site we collect the data shown in the comments form, and also the visitor’s IP address and browser user agent string to help spam detection.

An anonymized string created from your email address (also called a hash) may be provided to the Gravatar service to see if you are using it. The Gravatar service privacy policy is available here: https://automattic.com/privacy/. After approval of your comment, your profile picture is visible to the public in the context of your comment.

Media

If you upload images to the website, you should avoid uploading images with embedded location data (EXIF GPS) included. Visitors to the website can download and extract any location data from images on the website.

If you leave a comment on our site you may opt-in to saving your name, email address and website in cookies. These are for your convenience so that you do not have to fill in your details again when you leave another comment. These cookies will last for one year.

If you visit our login page, we will set a temporary cookie to determine if your browser accepts cookies. This cookie contains no personal data and is discarded when you close your browser.

When you log in, we will also set up several cookies to save your login information and your screen display choices. Login cookies last for two days, and screen options cookies last for a year. How long we retain your data

If you leave a comment, the comment and its metadata are retained indefinitely. This is so we can recognize and approve any follow-up comments automatically instead of holding them in a moderation queue.

For users that register on our website (if any), we also store the personal information they provide in their user profile. All users can see, edit, or delete their personal information at any time (except they cannot change their username). Website administrators can also see and edit that information.

What rights you have over your data

If you have an account on this site, or have left comments, you can request to receive an exported file of the personal data we hold about you, including any data you have provided to us. You can also request that we erase any personal data we hold about you. This does not include any data we are obliged to keep for administrative, legal, or security purposes.

End User License Agreement

This End User License Agreement (“Agreement”) is a legal agreement between the person, company or organization ("You" or “User”) licensing the software product known as “Interactive COC or App” (“iCOC”) and its licensors, as applicable. iCOC may only be obtained directly from the Apple Store or Google Play, and this Agreement applies only to “iCOC” whether or not other software or platforms are referred to or described herein. By installing and/or using iCOC you confirm your agreement to be bound by the terms of this Agreement.

Scope of License: The iCOC license (“License”) is a limited non-transferable license to use iCOC for purposes of personal use during the Term only on devices operating with Apple's ("iOS") and/or with Google's ("Android") operating systems ("Devices") that You own or control, and as otherwise permitted by this Agreement (the “Usage Rules”). Interactive COC reserves all rights not expressly granted to You. Interactive COC is the sole and exclusive owner of the App. You may not

distribute or make iCOC available over a network or other than through Apple Store or Google Play,
rent, lease, lend, sell, redistribute or sublicense iCOC,
copy (except as expressly permitted by this License and the Usage Rules), decompile, reverse engineer, disassemble, attempt to derive the source code of, modify, or create derivative works of iCOC, any updates, or any part thereof (unless expressly permitted by applicable law or by licensing terms of any open sourced components included in iCOC). Any attempt to do so is a violation of the rights of Interactive COC and subjects You to prosecution and damages. This License governs any upgrades provided by Interactive COC unless such upgrade is accompanied by a separate license in which case the terms of that license will govern.

Consent to Use of Data: You agree that Interactive COC may collect, compile, format, package and use technical data and related information, in accordance with its then current Interactive COC Inc Privacy Policy.

Termination. The License is effective during the Term unless earlier terminated by You or Interactive COC, and will terminate automatically without notice if You fail to comply with any term(s) of this License. Upon termination, Interactive COC will revoke Your license and You shall cease all use of iCOC, and destroy all full or partial copies.

Services; Third-Party Materials. iCOC may enable access to Interactive COC and third-party services and web sites ("Services") which may require Internet access. You accept any additional resulting terms of service.

You understand that during the use of Services You agree that Your use of the Services is at Your sole risk and that Interactive COC shall have no liability to You for content created by You, sent by You or lost by You, Your device or Internet connection.

Certain Services may display, include or make available content, data, information, applications or materials from or links to web sites of third parties (“Third-Party Materials”). By using the Services, You acknowledge and agree that

Interactive COC is not responsible for examining or evaluating the laboratory content, accuracy, completeness, timeliness, validity, copyright compliance, legality, quality or any other aspect of such Third-Party Materials or web sites, and does not warrant or endorse and does not assume and will have no liability or responsibility to You or any other person for any Services, Third-Party Materials or web sites, or for any other materials, products, or services of third parties;
Third-Party Materials and links to other web sites are provided solely as a convenience to You;
Location data provided by any Services or Third-Party Materials is for basic navigational purposes only and is not intended to be relied upon in situations where precise location information is needed or where erroneous, inaccurate or incomplete location data may lead to death, personal injury, property or environmental damage; and
Neither Interactive COC, nor any of its content providers, guarantees the availability, accuracy, completeness, reliability, or timeliness of any information or location data displayed by any Services or Third-Party Materials.

You agree that Services or Third-Party Materials contain proprietary content, information and material that is protected by applicable intellectual property and other laws, including but not limited to copyright, and You will not

use such proprietary content, information or materials in any way whatsoever except as expressly permitted herein;
tamper with or reproduce in any manner or form, or by any means any portion of the Services or Third-Party Materials may be;
modify, rent, lease, loan, sell, distribute, or create derivative works based on the Services or Third-Party Materials, in any manner;
exploit the Services or Third-Party Materials in any unauthorized way whatsoever, including but not limited to, by trespass or burdening network capacity;
use the Services or Third-Party Materials in any manner to harass, abuse, stalk, threaten, defame or otherwise infringe or violate the rights of any other party; and that Interactive COC is not in any way responsible for any such use by You, nor for any harassing, threatening, defamatory, offensive or illegal messages or transmissions that You may receive as a result of using any of the Services or Third-Party Materials.

Third party Services and Third-Party Materials may not be available and/or appropriate in all languages or in all countries/locations and Interactive COC makes no such representations. To the extent You access such Services or Third-Party Materials, You do so at Your own initiative and are responsible for compliance with any applicable laws, including applicable local laws. Interactive COC reserves the right to change, suspend, remove, or disable access to any Services or Third-Party Materials at any time without notice. In no event will Interactive COC be liable for the removal of or disabling of access to any such Services or Third-Party Materials. Interactive COC may in its sole discretion and at any time without notice limit use of or access to Services or Third-Party Materials.

No Warranty: You expressly acknowledge and agree that use of iCOC is at your sole risk and that the entire risk as to satisfactory quality, performance, accuracy and effort is with You. To the maximum extent permitted by applicable law, iCOC and any Services performed or provided by iCOC are provided "as is" and "as available," with all faults and without warranty of any kind. Interactive COC hereby disclaims all warranties and conditions with respect to iCOC and any Services or Third-Party Materials, express, implied or statutory, including, but not limited to, the implied warranties and/or conditions of merchantability, of satisfactory quality, of fitness for a particular purpose, of accuracy, of quiet enjoyment, and non-infringement of third party rights. Interactive COC does not warrant against interference with your enjoyment of iCOC, that the functions contained in, or Services performed or provided by iCOC will meet your requirements, that the operation of iCOC, Services or Third-Party Materials will be uninterrupted or error-free, or that defects in iCOC, Services or Third-Party Materials will be corrected. No oral or written information or advice given by Interactive COC or its authorized representative shall create a warranty. Should iCOC, Services or Third-Party Materials prove defective, you assume the entire cost of all necessary servicing, repair or correction. Some jurisdictions do not allow the exclusion of implied warranties or limitations on applicable statutory rights of a consumer, so the above exclusion and limitations may not apply to you.

Limitation of Liability. To the extent not prohibited by law, in no event shall Interactive COC be liable for personal injury, or any incidental, special, indirect or consequential damages whatsoever, including, without limitation, damages for loss of profits, loss of data, business interruption or any other commercial damages or losses, arising out of or related to your use or inability to use iCOC, Services or Third-Party Materials, however caused, regardless of the theory of liability (contract, tort or otherwise) and even if Interactive COC has been advised of the possibility of such damages. Some jurisdictions do not allow the limitation of liability for personal injury, or of incidental or consequential damages, so this limitation may not apply to you.

In no event shall Interactive COC’s total liability to you for all damages (other than as may be required by applicable law in cases involving personal injury) exceed the amount of fifty dollars ($50.00). The foregoing limitations will apply even if the above stated remedy fails of its essential purpose.

Export. You may not use or otherwise export or re-export iCOC except as authorized by United States law and the laws of the jurisdiction in which iCOC was obtained. In particular, but without limitation, iCOC may not be exported or re-exported (a) into any U.S. embargoed countries or (b) to anyone on the U.S. Treasury Department's list of Specially Designated Nationals or the U.S. Department of Commerce Denied Person’s List or Entity List. By using iCOC, you represent and warrant that you are not located in any such country or on any such list. You also agree that you will not use these products for any purposes prohibited by United States law, including, without limitation, the development, design, manufacture or production of nuclear, missiles, or chemical or biological weapons.

Commercial Items. iCOC and related documentation are "Commercial Items", as that term is defined at 48 C.F.R. §2.101, consisting of "Commercial Computer Software" and "Commercial Computer Software Documentation", as such terms are used in 48 C.F.R. §12.212 or 48 C.F.R. §227.7202, as applicable. Consistent with 48 C.F.R. §12.212 or 48 C.F.R. §227.7202-1 through 227.7202-4, as applicable, the Commercial Computer Software and Commercial Computer Software Documentation are being licensed to U.S. Government end users (a) only as Commercial Items and (b) with only those rights as are granted to all other end users pursuant to the terms and conditions herein. Unpublished-rights reserved under the copyright laws of the United States.

Governing Law. The laws of the State of California, excluding its conflicts of law rules, govern this License and your use of iCOC. Your use of iCOC, Services or Third-Party Materials may also be subject to other local, state, national, or international laws.

This Privacy Policy governs your use of the Interactive COC (“iCOC”) software application (App) for mobile devices. iCOC is an electronic chain-of-custody that collects Your entered information, compiles the data, creates a Portable Document Format (PDF) and sends it to Your chosen laboratory for their ease of entry.

User Provided Information. Interactive COC obtains information from You when you download, register and use iCOC. In order to register, You will be required to create an account by providing an existing, valid email address of your choice, a user created password, your cell phone number, your company name, company address & phone number. Additional information may be requested by Interactive COC, but will not be required.

When you use iCOC, you generally provide (a) a valid email address and password, (b) information you provide us when you contact us for a laboratory recommendation, help or feedback, and (c) information you enter into our system when using iCOC which will include your project information, the samples and delivery of samples. In the case of location-based services that you enter into the iCOC system or Global Positioning Satellites (GPS), the location feature that triggered the location of the project, the location of your sample and the pick-up of your samples. If you don’t allow iCOC to access your location information, you will not be able to receive location based data directly into your App and your enjoyment of the service will be limited.

Automatically Collected Information. Interactive COC may collect certain information about your mobile device automatically for the purposes of debugging issues. This information may include, but not be limited to the type of device, unique device ID, IP address, operating system, and how You use iCOC. This data is collected in a non-user identifiable manner, and is never shared with any third party. Information collected during debugging will be deleted after such debugging is complete.

Real Time Laboratory Information. iCOC is much more powerful and useful with laboratories that are listed in the iCOC Network. When you use iCOC, we recognize you like to use your favorite laboratory as you have a relationship and pricing structure that you are familiar with. As with any new endeavor, it is not possible to have every laboratory listed in the Network at the beginning of the launch of the App. As such, iCOC is asking that You request that your laboratory join the iCOC network as it will be no cost to them to set up. We do not recognize nor can we store any other laboratory information available on your device unless they are active participants in the iCOC Network. We do have a feature that will allow for You to use Your own company name as a laboratory that will offer All Fields of Testing that correspond to our chain of custody’s.

We will not share your data, laboratory or current location with other users or partners. All entries are and remain the property of Interactive COC. Chain of Custody entries are stored on the Interactive COC database that triggered the delivery of the chain of custody to your chosen laboratory. Interactive COC will provide aggregated data to the laboratory – and such results will never contain your password or unique device ID.

If you do not want us to use your location for the purposes set forth above, you may deny access to your location information by not using the location services in your mobile phone settings, but your enjoyment of the app will be limited.

Third-Party Access to User Provided, Automatically Collected and Real Time Information. Interactive COC may disclose User Provided, Automatically Collected and Real Time Information:

as required by law, such as to comply with a subpoena, or similar legal process;

when in good faith we believe disclosure is necessary to protect your safety or the safety of others, protect our rights, investigate fraud, or respond to a government request;
with employees or contractors with a need to know to operate, develop or improve iCOC and who are bound by this Privacy Policy;

if a change in control (merger, acquisition or sale of assets) of Interactive COC Inc results in any change in ownership or use of this information, in which case you will be notified via email and/or a prominent notice on our Web site of such changes as well as options available to you regarding the subsequent use of this information;

Opt-out Rights. Uninstalling iCOC using the uninstall functions and Delete All Data on your device, within iCOC oryour network will stop all further collection of information.

Data Retention Policy, Managing Your Information. User Provided Information is retained for as long as you have an account with Interactive COC and use the App, and for a reasonable time thereafter. To ask Interactive COC to cancel your account and remove your email address and password from our systems, contact us at help@interactivecoc.com. Deletion of this information will prevent your copy of iCOC from functioning properly, limiting your enjoyment of the Service. Automatically Collected Information is retained at Interactive COC’s option indefinitely.

Children. Interactive COC does not knowingly solicit data from or market to children under the age of 13, and children under 13 are prohibited from using iCOC. A parent or guardian may request that Interactive COC delete information provided without their consent at help@interactivecoc.com.

Security. The confidentiality of your information is important to Interactive COC. Certain physical, electronic, and procedural safeguards are used to protect information we process and maintain. In spite of such precautions, Interactive COC Inc cannot guarantee that we can prevent all potential security breaches or unauthorized disclosure of information.

Changes. Interactive COC may update this Privacy Policy from time to time for any reason and will notify you of any changes by posting at http://www.interactivecoc.com. Continued use of iCOC is deemed approval of all changes so please review this Policy on our website regularly. The history of this Privacy Policy can be reviewed at www.interactivecoc.com.

Your Consent. By using iCOC, you consent to the processing of your User Provided Information, Automatically Collected Information and Real Time Location Information You submit in accordance with this Privacy Policy, and as amended. "Processing,” means but is not limited to the use of cookies on your device or using or touching information in any way, including, but not limited to, collecting, storing, deleting, using, combining and disclosing information, all of which will take place under United States laws and requirements for data protection and processing (“US Law”). By using the Application outside the United States You consent to Processing under US Law. Interactive COC will not share your email address or demographic information attached to your email address with third parties.
